Why Timing in a Malpractice Case Is Crucial

We received a call from a 32-year old woman with concerns about a worsening serious injury because doctors initially failed to diagnose a colon cancer tumor on several CAT scans, making the diagnosis only during exploratory surgery.

The suit was thought to be against the radiologist – the doctor who may have misread the CAT scans.

We had to decline her case because there was a short delay between the missed diagnosis and the diagnosis itself. We would not have been able to prove that the cancer had spread significantly in that period of time. In fact, her later scans showed that it had not spread.
